General Terms and Conditions of "La Claire Fontaine",

vers. its operating company NBBH SARL, hereinafter Hotel.

These General Terms and Conditions govern the legal relationship between you as a guest or agency, hereinafter the client and the Hotel.

1. Conclusion of the contract

The accommodation contract is deemed concluded upon receipt of any of the following: a reservation confirmation signed by the client, a written confirmation by email containing all relevant booking details, the payment of a deposit, or a booking made via an online booking system, including the hotel’s official website. If the booking client registers additional guests, the booking client shall be fully liable for the contractual obligations of all registered guests.

2. Scope of Services

The specific services to be provided by the hotel are defined exclusively by the reservation confirmation. If the client requests services that are not provided directly by the hotel, the hotel shall act solely as an intermediary. Such third-party services shall be invoiced separately and are subject to the terms and conditions of the respective service provider.

3. Payment Terms

Upon conclusion of the contract, the hotel is entitled to request a deposit or full prepayment of the agreed room rate as well as any separately booked services. The applicable payment terms shall be specified at the time of booking via the hotel’s web portal or the respective booking platform. Room rates based on non-refundable conditions or package offers shall be charged in full to the client’s credit card at the time the booking becomes binding. Any deposit paid shall be credited against the total accommodation price due or, in the event of cancellation, against any applicable cancellation fees. In addition to a deposit, the hotel may require a valid credit card guarantee and the client’s signature. Credit card details shall be used solely to secure the reservation. Any outstanding balance shall be settled on site in accordance with the agreed payment arrangements. The deposit is due immediately upon reservation. This deadline may vary depending on the season. If the deposit is not received within the specified timeframe, the hotel reserves the right to withdraw from the contract after a grace period of five (5) days and to charge the cancellation fees set out in Section 4. The final invoice must be settled in cash or by an accepted credit card (Visa or Mastercard) at check-out. Unless otherwise agreed, hotel invoices are payable within ten (10) days from the invoice date without deduction.

4. Changes, cancellations and no-show

Changes and Cancellations of Bookings

For the timely cancellation or modification of a booking, the decisive factor shall be the receipt of the written cancellation or change request by the hotel’s central reservations department, as well as the subsequent written confirmation by the hotel.

Cancellations of Internet-Based Bookings

Cancellations of bookings made via internet-based booking systems are only legally effective if they are carried out through the respective booking platform, in accordance with the applicable cancellation conditions, and confirmed by the hotel.

In the event that the client withdraws from the contract, the following cancellation fees shall apply, depending on the booking type:

Up to 21 days prior to arrival: free of charge
20 to 15 days prior to arrival: 30% of the total booking amount
14 to 6 days prior to arrival: 80% of the total booking amount, provided the suite cannot be re-let
4 to 0 days prior to arrival or No-Show: 100% of the total booking amount

5. Check-in and Check-out

Rooms are available from 3:00 p.m. on the day of arrival at the latest. On the day of departure, rooms must be vacated by 12:00 noon. In the event of late check-out, the hotel reserves the right to charge up to 50% of the room rate. If the room is vacated after 6:00 p.m., the full room rate shall be charged.

The client has no entitlement to a specific room unless expressly agreed in writing. Rooms may be used exclusively for accommodation purposes. The hotel reserves the right to terminate the contract with immediate effect if it was concluded on the basis of false or misleading information or if the room is used in breach of the contract.

5. Liability of the Hotel

The hotel shall be liable for items brought in by the client in accordance with the applicable statutory provisions. Liability for slight negligence is excluded, insofar as legally permissible. The hotel shall not be liable, under any legal title, for services provided by third parties that have been merely arranged by the hotel (see Section 3). Any damage, defect, or dissatisfaction with hotel services must be reported to the hotel immediately. Failure to do so shall result in the forfeiture of any related claims. All claims against the hotel shall become time-barred four (4) weeks after termination of the contract. Non-contractual liability shall be governed by statutory provisions, subject to further limitations and exclusions set out in these General Terms and Conditions.

6. Data Protection / Privacy Policy

Personal data transmitted by the client shall be processed and disclosed only to the extent necessary for the execution of the booking and based on moroccan law. Data shall not be passed on for any other purposes. In all other respects, data processing shall be carried out in compliance with the applicable data protection regulations. 7. Applicable Law and Place of Jurisdiction

All reservation agreements, these General Terms and Conditions, and any related agreements shall be governed exclusively by Moroccan law. The exclusive place of jurisdiction for all disputes arising from or in connection with these General Terms and Conditions shall be Marrakesh.
